Terms of Use
These Terms of Use (“Terms”) are an agreement between you and BurningFlower INC (“we”, “us”) for the Cradle Story app (the “App”). By downloading or using the App, you agree to these Terms and to Apple's Licensed Application End User License Agreement (“Apple EULA”). If these Terms and the Apple EULA conflict, these Terms apply to the extent the Apple EULA allows. If you don't agree, please don't use the App.
1. What the App is
Cradle Story is a simulation for learning and entertainment. You care for a fictional baby, receive simulated reminders and alarms, read short knowledge cards, and can optionally compare your experience with a partner. Events in the App are simplified and do not predict what any real child will do.
2. Not medical advice
The knowledge cards summarize public information from sources such as the AAP, CDC and WHO, with sources and dates shown. They are general information only. They are not medical advice, diagnosis or treatment, and they may not reflect the latest guidance. Always ask a pediatrician or other qualified professional about a real child's health. In an emergency, call 911 or your local emergency number. Do not delay or ignore professional advice because of something you read in the App.
3. Who can use it
The App is made for adults. You must be at least 16 years old to use it. If you are under the age of majority where you live, you may use it only with permission from a parent or guardian, who agrees to these Terms for you.
4. License
We grant you a personal, non-transferable, non-exclusive license to use the App on Apple devices you own or control, as permitted by the Apple EULA and the App Store usage rules. You may not copy, modify, reverse engineer, resell or redistribute the App or its content, except as the law allows.
5. Purchases
- The App is free to download. “Unlock First Six Months” is a one-time in-app purchase, not a subscription.
- All purchases are made through Apple and are subject to Apple's terms. Prices are shown in the App Store before you buy and may change.
- Refunds are handled by Apple under its policies; we can't issue refunds directly.
- Family Sharing is supported where Apple makes it available.
- Your purchase unlocks content in the App; it does not give you ownership of that content. If we discontinue the App, we have no obligation to keep providing it.
6. Partner invites and your content
When you send an invite, the baby's name, sex and temperament, your nickname and short comparison summaries are shared with the person who joins (see the Privacy Policy). You are responsible for what you enter. Please use a made-up baby and don't enter real personal information about a child or anyone else. You give us a limited license to store and transmit this content only to run the invite feature. You can revoke an invite at any time.
7. Acceptable use
Don't use the App to harass anyone, to share offensive, unlawful or infringing names or nicknames, to try to guess or collect invite codes, to interfere with our servers, or to break the law. We may revoke invites or block access to the invite service if these rules are broken.
8. Changes to the App
We may update, change or remove features or content, including knowledge cards, at any time, for example to correct information or follow new guidance. Some features depend on iOS versions, Apple services, permissions you grant and an internet connection, and may not always be available. Real Night alarms and Live Activities are delivered by iOS, and we can't guarantee their timing.
9. Our content
The App, including its illustrations, sounds, text and software, belongs to us or our licensors and is protected by law. Linked third-party sources belong to their owners.
10. Disclaimers
To the fullest extent permitted by law, the App is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We don't warrant that the App will be uninterrupted or error-free or that its information is complete or current.
11. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, arising from your use of the App or reliance on its content. Our total liability for any claim relating to the App is limited to the amount you paid for the App in the 12 months before the claim. Some places don't allow these limits, so they may not apply to you.
12. Ending these Terms
You can stop using the App at any time by deleting it. We may suspend your access to online features if you break these Terms. Sections 2, 9, 10, 11 and 13 continue after these Terms end.
13. Governing law
These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict-of-law rules, except where the law of your place of residence requires otherwise. Nothing in these Terms limits rights you have under consumer protection laws that can't be waived.
14. Apple
These Terms are between you and us, not Apple. Apple is not responsible for the App or its content, has no obligation to provide maintenance or support, and is not responsible for any product claims relating to the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
15. Updates to these Terms
We may update these Terms. We will change the date at the top, and for significant changes we will tell you in the App. Continuing to use the App after a change means you accept it.

本使用条款（“本条款”）是你与 BurningFlower INC（“我们”）之间就 Cradle Story App（“本 App”）达成的协议。下载或使用本 App，即表示你同意本条款以及 Apple 的《许可应用程序最终用户许可协议》（“Apple EULA”）。本条款与 Apple EULA 冲突时，在 Apple EULA 允许的范围内以本条款为准。不同意的话，请不要使用本 App。
1. 本 App 是什么
Cradle Story 是一款用于了解和娱乐的模拟应用。你照顾一个虚构的宝宝，收到模拟的提醒和闹钟，阅读简短的知识卡，也可以选择和另一半对照彼此的经历。App 中的事件经过简化，不代表任何真实孩子会怎样。
2. 不构成医疗建议
知识卡整理自 AAP、CDC、WHO 等来源的公开资料，并注明来源和日期，仅供一般了解。它们不构成医疗建议、诊断或治疗，也可能不是最新指南。关于真实孩子的健康，请咨询儿科医生或其他合格专业人员；紧急情况请拨打 911 或当地急救电话。不要因为 App 中的内容而延误或忽视专业意见。
3. 谁可以使用
本 App 面向成年人。你必须年满 16 周岁才能使用。如果你未达到所在地的法定成年年龄，须经父母或监护人同意后使用，并由其代你同意本条款。
4. 许可
我们授予你个人的、不可转让的、非独占的许可，可在你拥有或控制的 Apple 设备上，按 Apple EULA 和 App Store 使用规则使用本 App。除法律允许外，你不得复制、修改、反向工程、转售或再分发本 App 或其内容。
5. 购买
- 本 App 免费下载。“解锁前六个月”是一次性 App 内购买，不是订阅。
- 所有购买都通过 Apple 进行，适用 Apple 的条款。价格在购买前显示于 App Store，可能调整。
- 退款由 Apple 按其政策处理，我们无法直接退款。
- 在 Apple 提供的范围内支持家人共享。
- 购买解锁的是 App 内的内容，不代表你拥有这些内容。如果我们停止提供本 App，不负有继续提供的义务。
6. 伴侣邀请和你填写的内容
发出邀请时，宝宝的名字、性别、性格，你的昵称和简短的对照摘要会分享给加入的人（见隐私政策）。你对自己填写的内容负责。请使用虚构的宝宝，不要填写任何真实孩子或他人的个人信息。你授予我们有限的许可，仅为运行邀请功能而存储和传输这些内容。你可以随时撤回邀请。
7. 使用规范
不得利用本 App 骚扰他人，不得使用冒犯性、违法或侵权的名字或昵称，不得尝试猜测或收集邀请码，不得干扰我们的服务器，不得从事违法行为。违反这些规定时，我们可以撤回相关邀请或停止提供邀请服务。
8. App 的变更
我们可以随时更新、修改或移除功能和内容（包括知识卡），例如为了更正信息或跟进新的指南。部分功能依赖 iOS 版本、Apple 服务、你授予的权限和网络连接，不一定始终可用。真实一夜的闹钟和实时活动由 iOS 投递，我们无法保证其准时。
9. 我们的内容
本 App 及其插画、声音、文字和软件归我们或我们的许可方所有，受法律保护。链接到的第三方来源归其各自所有者。
10. 免责声明
在法律允许的最大范围内，本 App 按“现状”和“现有”提供，不作任何明示或默示的保证，包括适销性、特定用途适用性、准确性和不侵权的保证。我们不保证本 App 不中断、无错误，也不保证其信息完整或最新。
11. 责任限制
在法律允许的最大范围内，对于因使用本 App 或依赖其内容而产生的任何间接、附带、特殊、后果性或惩罚性损害，或数据丢失，我们不承担责任。我们就本 App 的任何索赔承担的总责任，以索赔前 12 个月内你为本 App 支付的金额为限。部分地区不允许上述限制，届时可能不适用于你。
12. 条款终止
你可以随时删除本 App 停止使用。你违反本条款时，我们可以暂停你使用在线功能。第 2、9、10、11、13 条在本条款终止后继续有效。
13. 适用法律
本条款适用美国怀俄明州（Wyoming）法律，不考虑法律冲突规则；你居住地法律另有强制规定的除外。本条款不限制你依据不可放弃的消费者保护法律享有的权利。
14. 关于 Apple
本条款是你与我们之间的协议，不是与 Apple 的协议。Apple 不对本 App 或其内容负责，没有义务提供维护或支持，也不对与本 App 有关的任何产品索赔负责。Apple 及其子公司是本条款的第三方受益人，可以对你执行本条款。
15. 条款更新
我们可能更新本条款，届时会修改顶部日期；重大变更会在 App 内告知你。变更后继续使用即表示你接受。
